Just wondering is it legal for your pitcher to use this? do they have to keep it in their pocket? Or leave it in the dugout?

Legal in USA and high school/NFHS play. It must be kept in the pitcher's back pocket.

Somebody else would have to answer for the other alphabets sanctioning bodies.
